1. Scope of This Disclaimer
This Limitation of Liability and Disclaimer (“Disclaimer”) applies to all services performed by I&G Construction Services LLC (“Company,” “we,” “us,” or “our”), including but not limited to deck construction, siding installation, general contracting, and any related or ancillary work. By engaging our services, you (“Client”) agree to the limitations set forth herein.
This Disclaimer is incorporated by reference into all project contracts, estimates, and agreements with the Company.
2. Limitation of Liability — During Construction
The Company shall not be liable for any damage, injury, loss, or disruption that occurs during the construction process that is outside the Company’s direct control, including but not limited to:
- Damage resulting from weather events, high winds, rain, flooding, or acts of God during the construction period.
- Damage caused by underground utilities, buried lines, pipes, septic systems, or other obstructions not disclosed by the Client or identified on utility locate reports.
- Structural failures resulting from pre-existing conditions in the Client’s property (e.g., rot, settlement, defective framing, or inadequate foundation).
- Incidental damage to landscaping, driveways, walkways, or lawn areas caused by normal and necessary construction activity (equipment access, material staging, foot traffic).
- Personal injury to any person who enters the active work site without authorization or who fails to heed posted warnings.
⚠ Clients and third parties are not permitted on active work sites without Company supervision. The Company is not responsible for injuries to unauthorized persons who enter the work area.
3. Limitation of Liability — After Project Completion
The Company’s liability following project completion is expressly limited as follows:
- The Company shall not be liable for damage, deterioration, or failure resulting from the Client’s failure to maintain the completed work in accordance with applicable maintenance guidelines.
- The Company shall not be liable for damage caused by improper use, overloading, modification, or alteration of any completed structure by the Client or third parties.
- The Company shall not be liable for Acts of God, extreme weather, flooding, freezing, or other events beyond the Company’s control occurring after project completion.
- The Company shall not be liable for indirect, consequential, incidental, or punitive damages of any kind.
- The Company’s total liability for any claim shall not exceed the total contract price paid by the Client for the specific work at issue.
4. Natural Wood Disclaimer — No Warranty on Wood Materials
The Client acknowledges and agrees to the following regarding natural wood:
- Natural Variation: Wood is a natural material that varies in grain, color, density, and appearance. Knots, checks, splits, color variation, and grain patterns are inherent characteristics, not defects.
- Checking & Cracking: As wood acclimates to outdoor environments, it is normal and expected for boards to develop checks (cracks along the grain). This is a natural response to humidity, temperature changes, and moisture cycles — not a construction defect.
- Warping & Movement: Wood naturally expands and contracts with seasonal moisture and temperature changes. Minor movement, bowing, or cupping of individual boards is an inherent characteristic of natural wood and is not covered.
- Color Change & Weathering: Untreated or unsealed wood will naturally gray and weather over time when exposed to sunlight and moisture. This is not a defect.
- Rot & Decay: Even pressure-treated lumber has a finite lifespan in ground contact or high-moisture environments. The Client is responsible for applying sealers, stains, and protective coatings and maintaining proper drainage around wood structures.
- Insect & Pest Damage: The Company is not responsible for damage caused by termites, carpenter ants, wood-boring beetles, or other insects following project completion.
- Manufacturer Warranties: Any manufacturer warranties on specific materials (e.g., composite decking, hardware, fasteners) are the responsibility of the manufacturer and must be pursued directly by the Client.
The Client acknowledges that they have been informed of these natural wood characteristics and accepts them as inherent to the material and not as defects in workmanship or materials provided by the Company.

6. Workmanship Responsibility
While the Company does not offer a blanket warranty on materials, the Company stands behind the quality of its workmanship. If a defect in workmanship (i.e., an error in installation technique, fastening, or structural assembly that is the direct result of our work) is identified within one (1) year of project completion and reported to us in writing, we will evaluate and, at our discretion, correct verifiable workmanship defects at no charge.
This workmanship responsibility does not apply to:
- Damage caused by Client neglect, modification, or misuse.
- Normal wear, weathering, or aging of materials.
- Issues arising from natural wood characteristics as outlined in Section 4.
- Conditions caused by events outside the Company’s control after project completion.
7. Client’s Assumption of Risk
The Client acknowledges that construction activities carry inherent risks and that certain outcomes — including minor property disturbance, dust, noise, and disruption — are unavoidable. By engaging the Company’s services, the Client voluntarily assumes these inherent risks and waives claims against the Company arising from such ordinary and expected construction conditions.
8. Governing Law
This Disclaimer shall be governed by the laws of the State of Tennessee. Any dispute arising from these provisions shall be subject to the dispute resolution procedures outlined in the Company’s Terms and Conditions.
